LIABILITY DISCLAIMER
I hereby release New Zealand Red Cross (NZRC) from any claims for any loss, damage, or injury sustained while participating in the Red Cross Journey.
I acknowledge that NZRC does not provide any liability insurance for protection of individuals, business entities, groups, organisations, spectators, or others who may participate in the Red Cross Journey.
In consideration for participation in the Red Cross Journey, the individual, business entity, group, organisation, spectator, or other, does hereby release and forever discharge NZRC, and its officers, board, employees and volunteers, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by supporting the Red Cross Journey as a participant.
This disclaimer extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, damages, losses and liability and the consequences thereof, as well as those now disclosed and known to exist. The provisions of any New Zealand law (whether statute or case law) to the effect that a release or indemnity shall not extend to claims, demands, injuries or damages which are unknown or unsuspected to exist at the time of execution of this form are hereby expressly waived.
I hereby agree on behalf of my heirs, executors, administrators, and assigns, to indemnify NZRC and its officers, board, employees and volunteers, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by supporting the Red Cross Journey as a participant.
It is further understood and agreed that supporting the Red Cross Journey as a participant is not to be construed as an admission of any liability and acceptance or assumption of any responsibility by NZRC, its officers, board, and employees and volunteers, jointly and/or severely, for any damages and expenses for which NZRC, its officers, board, and employees, become liable or would become liable but for the terms of this disclaimer as a result of any alleged act or omission of the Red Cross Journey participant or any member of the public
